Cardient is made by Lamig Software ("we", "us"). These terms apply to the Cardient iPhone and iPad app and to this website.
1. Acceptance
By downloading or using Cardient you agree to these terms. If you do not agree, do not use the app.
2. Licence to use
We grant you a limited, non-exclusive, non-transferable, revocable licence to use Cardient for your own personal, non-commercial collection tracking. You may not reverse-engineer, copy, modify, resell or redistribute the app, and you may not scrape or abuse our card-data service.
Cardient has no user accounts. There is nothing to register, and nothing to log in to. Your access is tied to the device the app is installed on.
3. Subscriptions and billing
Cardient is free to use with a daily scan limit. Cardient Pro is an optional auto-renewing subscription, sold and billed by Apple through In-App Purchase. The billing periods available, and the price of each, are shown on the purchase screen in the app before you buy.
The price is the one shown in the App Store for your country. It is displayed in your local currency on the purchase screen and confirmed by Apple before you are charged. Prices differ between storefronts and can change; the figure shown to you at the moment of purchase is the one that applies.
- Free trials and introductory offers. A subscription may be offered with a free trial or another introductory offer. Where one applies, its length and what happens when it ends are shown on the purchase screen before you buy. Unless you cancel at least 24 hours before a trial ends, it converts automatically to a paid subscription and your Apple ID is charged. Any unused portion of a free trial is forfeited if you buy a subscription before the trial ends.
- Auto-renewal. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours beforehand. Your Apple ID is charged for the renewal within 24 hours of the end of the current period.
- Cancelling. Cancel at any time in iOS Settings → your name → Subscriptions → Cardient. Cancelling stops future renewals; you keep Pro until the end of the period you have already paid for. There are no refunds for partial periods.
- Refunds are handled by Apple, not by us. Request one at reportaproblem.apple.com.
- Price changes. We may change subscription pricing. Apple will notify you before any change affects you, and where Apple requires it your consent will be sought before the new price is charged.
All billing is handled by Apple. We never receive or store your payment card or billing details.
4. Card valuations — estimates, not financial advice
Card values shown in Cardient are estimates, sourced from third-party market data, describing recent market activity for a particular printing of a card. They are provided for informational and collection-management purposes only.
We do not provide financial, investment, appraisal or trading advice. Valuations are not guarantees, not offers to buy or sell, and actual sale prices may differ materially. Prices may be stale, wrong, or missing for a given card. Do not make buying, selling or insurance decisions on the basis of a number shown in Cardient alone. We are not responsible for any loss arising from reliance on in-app valuations.
5. Centering measurement and grading estimates
Cardient measures the centering of a card from a photograph and compares what a card is worth raw against what it is worth graded.
Cardient does not grade cards and cannot predict a grade. It is not affiliated with PSA, BGS, CGC or any grading company, and nothing it shows is a grade, a promise of a grade, or a guarantee that a card will receive one. Centering is one of several factors a grader considers; surface, edges, corners, print quality and centering measured by hand on the physical card can all differ from what a photograph shows. A measurement taken from a photograph is also only as good as the photograph: lighting, glare, sleeves and toploaders, reflections, camera angle, image resolution, and how clearly the card's borders are visible all affect the result — as does where the measurement guides are placed, since small differences at the edge move the percentage more than most people expect. Any statement about whether submitting a card is "worth it" is an opinion derived from estimated market values, and the decision — and the submission fee — is yours.
6. Your content
The collection data you enter is yours. You grant us only the limited permission needed to store and process it in order to provide the service to you, as described in the Privacy Policy. We do not sell your collection data.
You are responsible for what you photograph with the app.
7. Acceptable use
You must not:
- break any applicable law or regulation while using Cardient;
- reverse-engineer, scrape, overload or otherwise abuse the card-data service or attempt to defeat scan limits;
- redeem promotional codes you were not given, or automate their redemption;
- impersonate any person or entity; or
- introduce malicious code or interfere with the app or its infrastructure.
We may suspend access from a device that does any of the above.
8. Availability and changes
Cardient depends on internet services, including our own servers and third-party providers. We do not guarantee it will be available, uninterrupted or error-free, and we may change, suspend or discontinue features — including the card catalogue and price data — at any time. Scanning requires an internet connection.
9. Third-party rights
Cardient is an independent app. It is not affiliated with, endorsed by or sponsored by The Pokémon Company International, Nintendo, Game Freak, Creatures Inc., or any card-grading company. Pokémon and all associated names and marks are the trademarks of their respective owners, used here only to describe the cards the app identifies.
10. Disclaimer of warranties
Cardient is provided "as is" and "as available", without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where a guarantee applies and cannot be excluded, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profit, data or goodwill, arising from or connected with your use of Cardient. To the maximum extent permitted by law, our total liability in connection with the app is limited to the amount you paid us for it in the twelve months before the claim arose.
12. Termination
You may stop using Cardient at any time by deleting the app; see the Privacy Policy for how to have server-side data deleted. We may terminate or suspend access for breach of these terms. Sections 4, 5, 9, 10, 11 and 13 survive termination.
13. Governing law
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer laws of the country you live in.
14. Apple
These terms are between you and us, not with Apple. Apple is not responsible for Cardient or its content, and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them against you.
15. Changes to these terms
We may update these terms. We will change the date at the top when we do, and continued use of the app after that constitutes acceptance.
